How To File A DMCA Complaint Letter
We would first like to state that we are not lawyers nor do we practice law. This post is merely from information we have collected at various sites that helped us in the past. We urge you to contact a DMCA attorney in these matters.
Now then; as things progress in the marketing world and new affiliate marketers and bloggers make it onto the Internet, so too does plagiarism and the intense amount of information being stolen and placed online for backlinking and sales pitches. So while you may see your article posted elsewhere, they should always have the links to your website or product in place.
Quite often, bloggers and marketers will use your article on their blogs and forums, but most good ones will leave your article intact. The bad bloggers on the other hand will most certainly remove these links and any recognition. When this happens you must take action - for every person that does a search under your keywords, and clicks on the plagiarized article, that is one less person who visits your site. Basically, the article thief is stealing your traffic and quite possibly your sales.
Prior to sending a "cease and desist" letter, its best to be sure your work could not be constituted under the "Fair Use Doctrine" - As always with any information you see on WebTemplex, we urge you to please consult an attorney in any and all business and personal matters.
Send a DMCA Cease & Desist Letter
The first step is usually (but you don't have to) by sending the webmaster a message asking them to fix or remove the unauthorized material at once and that if they don't comply there will be additional consequences. Here is an example letter: (please consult with an attorney for your letter)

This is a Notice of Infringement as authorized in § 512(c) of the U.S. Copyright law under the (DMCA) Digital Millennium Copyright Act of 1998.

Please remove this article immediately or we will be forced to file an official complaint with your hosting company, the U.S. Copyright Office, Google Adsense (if applicable) and Google, Inc (Google Search).
